Former Panamanian Dictator Manuel Noriega is suing Activision over how he was depicted in Call of Duty: Black Ops 2’s campaign mode. The lawsuit has been brought to a Los Angeles court.

Noriega is portrayed as the enemy throughout the campaign mission, shown to be deceiving the CIA and shooting his own private military force operatives.

Courthouse News Service report states the Noriega is suing over the usage of his image and character in a title, lost profits, and for how he was depicted: ‘as a kidnapper, murderer, and enemy of the state.’

“In an effort to increase the popularity and revenue generated by BLACK OPS II, defendants used, without authorization or consent, the image and likeness of plaintiff in BLACK OPS II.

Noriega claims the video game portrays him “as a kidnapper, murderer and enemy of the state. An objective of one portion of ‘Black Ops II’ is solely to capture plaintiff.”

The lawsuit says that the depiction of Noriega in game “[created]Β the false impression that defendants are authorized to use plaintiff’s image and likeness. This caused plaintiffs to receive profits they would not have otherwise received.Β ” The lawsuit also states that he is suing for theΒ “blatant misuse, unlawful exploitation and misappropriation for economic gain” of his image in the video game, “Call of Duty: Black Ops II.”Β

Noriega says that Activision used his character to “to heighten realism in its video game, ‘Black Ops II.’ This translates directly into heightened sales for defendants.”

Here’s a video of some of the scenes that Noriega appears in; in this footage we seem him being capture by the CIA:

First lindsay lohan and now Manuel.

It seems like suing videos games publishers and Devs is a good way to get money.

    • Grenada!

Lindsay Lohan won’t get a dime because the judge will just laugh at her. Manuel is in prison for life isn’t he? So why the fuck would he need money? This shit funny to meeee.

Does anybody else think “Refinery” could be a MP map name? Is it just a coincidence that is the player selected in the image AND the players name does not end with “MP 01” – like every other player BUT a name! Hummm…

Jordan pointed this out in one of his videos, it was a good find.

          • jordanxbrookes

Ok, thanks Brady πŸ™‚ Well some people saw it and immediately wondered if it was a map name, but I guess I was just one of the few to actually report in a video on YouTube.

You do know that this is irrelevant to the article, right? Can’t you post that on an Advanced Warfare article?

      • Josh

We have had no new Advanced Warfare news – and posting it on a old article would be pointless as no one would see it.

        • Pathetic.

Would you also say that to an admin?

          • Tom

What would he say exactly? This is a COD website and you can share your views and opinions in the comment section. The comment section is not strictly made for that exact post and the mod has the power to remove or ban content that may be deemed as offensive or inappropriate.

What make a full point then? I stated my reasoning for posting on this article. Pointing out that he is being a hypocrite is not idiotic, but rather mocking HIM for doing the the exact same thing as he accused me of doing!

        • Siftblade of Rivia

Well it’s not relevant to the article, but it’s relevant to the comment which he replied to. Therefore it is relevant. He’s not really a hypocrite unless he replied to you with something completely unrelated.

    • Poop

      This is totally not relevant.

  • Well… At least it makes sense…

  • Should this see a favorable decision for Noriega, this could spell danger for the creative liberty all developers have to craft their stories however they see fit.

I don’t see this going anywhere because it assumes Activision had malicious intent with the use of his image, which I seriously doubt.

    • Keshav Bhat

This is the danger tho. A developer using someone’s real name and appearance in a game without permission and without compensation? There has to be a boundary to what you can use of a person.

      • There’s nothing that could assure us that, if his name was changed, one could connect the dots and still sue – see Lindsey Lohan vs Rockstar.

Treyarch’s writers had a reason to use Noriega in their story – I’m in favor of their original, non-modified, vision for the story.

      • TheShadowReaper

art has no bounds, and games are a form of art. with this argument alone AVTI can take down this piece of shit, but i have no doubt they will find even better arguments. they need to.

  • Kyle Emery

Fuck disgusting some people are? ITS ONLY A GAME YOU TWATS!!!!! You can’t blame Activison for everything they’ve put alot of Effort and money into this game fucking Foreiners they piss you right off get gone bk to your own country?? Fucking assholes? Now you putting tryarch into shit Geeeeezzzz its only a game?TRYARCH ignore these peace of shit assholes you’ve done nothing wrong fuking fagots… RESPECT Tryarch youve done brill on this game and thank you alot..

    • HuskySpoof

No dude, this is some serious shit that is being dealt with. Your fanboy cry won’t be heard. It’s just the way it is.

      • Kyle Emery

Soo? Its wrong its only a game. Whats the world coming to

        • HuskySpoof

It is, but many of the characters that were depicted are/were indeed real. This is a very serious matter. A person of some sort of notoriety portrayed in an uncanny manner causes a negative influence on their image and reputation. It’s not about whether it’s a game or not anymore. This is real people, real life.

          • Kyle Emery

            Ok i agree πŸ™‚

          • HuskySpoof

No worries. It’s not like I support the guy, I’m just trying to get the message across. Thank you for your co-operation.

          • TheShadowReaper

in a realistic setting, in order to immerse someone into it you need to include real life people, objects or situations. so you say that because someone doesnt like how he is depicted somewhere developers should get handcuffed and not go wild into their imagination? instead of rewarding people for being creative we punish them? what kind of logic is that? art has no bounds, and games are a form of art. enough said.

    • Ray

Being foreign has nothing to do with it, leave your racism out of it. How would you feel if someone used your image in a game and had you portrayed as a villain

      • Kyle Emery

I wouldnt care tbh and this person is proberley foreign n no i anit racist

      • RdJokr

But the guy wasn’t a saint either. Dude was charged for racketeering, money laundering,… the shit that mobsters do back in the day. Wouldn’t be surprised if he killed a couple of people.

        • Kyle Emery

Oh right i get you n
ow πŸ™‚ just dont seem the point in all of this tbh

      • Poop

He’s a dictator. His people most likely see him as a Villain.

    • Native

Yeah I definitely don’t blame the guy. In all honesty, I didn’t even know the guy was real. But knowing that, why would someone want an entire studio of game developers to portray them as a terrorist? Especially without direct consent. Yes it was a good game, but it is their fault for portraying him the way they did. They don’t have to use the names of real people, they could’ve made up some other name for him the game would’ve sold just as much. Again, I agree that they make great games, but they did drop the ball on this aspect of it.

    • Keshav Bhat

Bro, do you understand what’s happening? Activision used his whole appearance and his real name in their game without asking for his permission, then went and depicted him in such a way.

      • Poop

Theres a movie about the assassination of Kim Jong Un called the Interview. In Black Ops, Castro was made out to be a crazy brainwasher associated with the Russians. You think they asked for their permission? No. Portrayal is used in media all the time, especially when it comes to people like dictators or other men or women in power.

  • Ray

Unlike Lohan, I think this guy might have a pretty good case here. The in game character is clearly him, in likeness and in name.

    • Quint

I mean the key difference is that Manuel Noriega was a terrible leader and most of what they depict him doing probably happened (albeit not with the Call of Duty characters). Probably why it’s taken him this long to sue to be honest.

  • RdJokr

For the record, Noriega wasn’t that much of a good guy either. He’s just butthurt that he isn’t getting any money for being portrayed in the game.

  • ccrows

You just can’t make this S*** up… *sigh*

  • cookie

What’s your guys favourite CoD campaign? πŸ™‚

    • Guywithbrains

      Ghosts > MW3 > BO2 = MW2

    • jordanxbrookes

MW2 all the way, in fact, I’d say all the Modern Warfare’s. The Modern Warfare storyline was truly something amazing, and is something to tell our kids in the future, whilst they’d been playing Mario Kart 15 on their Wii-Xperia and Call of Duty: Robot Warfare on their Xbox FIBRE, or something like that haha.

      • Guywithbrains

I always liked Infinity Ward’s Modern Warfare series over Black Ops. Mainly because of campaigns, but multiplayer is better too. πŸ˜€

    • ben wills

BO1, MW1 and MW2 are all in a legendary tier. Probably BO1 if I had to choose, but that could switch any day.

    • Batman

      BO2>BO1>WaW>rest

  • What I dont get is nori said it translates to higherprofits for the way he is portrayed?
Im sure that noone said “the only reason im buying bo2 is due to Manuel being the bad guy”

And how does this reflect bad on him, isnt he in jail for money laudering or some shit like that?
thats like bin laden being put in gta and not trevor and (if he was still alive) him suing rockstar because he was portrayed as a bank robber -.-

    • Lol

This is some funny shit XD.

    • jordanxbrookes

Imagine GTA VI with Bin Laden as the bad guy :O

      • I get that thats funny but you really shouldn’t joke about that.. not trying to hate but many innocent americans including children lost their lives to that fucker and it doesnt seem right to joke about that.. Just sayin

        • jordanxbrookes

I know, that’s why Roskstar wouldn’t do that.

        • Hell, Bin Laden deserved so much slower and more painful of a death then he got. I had my way he would of been tortured before having someone decide to slowly cut through his neck. Then pissed on and thrown in the garbage.

          • Charles

I never found it in good taste to celebrate over his death how ever, like some people did

          • QuickzZ-_-GhosT

Then we would be like them, ruthless.

      • Bin laden, hitler and kim jong il = gta vi

      • NuttyTheSquirrel

Noriega is still kinda right. They used him as a piece of shit in the game (not that he wasn’t one but…), they called him sme fucked up shit without his permission, yada yada yada…

Treyarch still did not have the right to use him as a character and call him all that shit.

        • Siftblade of Rivia

Many TV shows and and movies use public figures like Obama, Kim Jong Un, even JFK, Nixon, and Abraham Lincoln, or Hitler. It’s like reading a criticizing article on the figure, or watching a video that criticizes them. Why can’t they put it in video games. Also, there’s something called an alternate reality. Abraham Lincoln became a vampire hunter, Nixon and JFK fought zombies in BO1, Kim Jong Un is in that upcoming movie, etc. If you’re a normal person, I understand, but as a massive public figure you kinda lose the right to not be used in movies, video games, etc. I know that sounds wrong, but that’s just how it is.

          • Brady the Defiled (sillibk)

Why can’t they put them in video games? Because it’s called the law. You are not allowed to use someone else’s likeness without their permission. This is a spitting image of Noriega.

          • MichiganerE

What about Castro? He was in Black Ops 1 without permission.

          • Brady the Defiled (sillibk)

He hasn’t acknowledged it, otherwise he could bring it to court, and sue Activision, like Noriega. Well, only if they use his likeness negatively, apparently. Using your likeness positively never goes to court, for some reason.

          • NuttyTheSquirrel

1- Fidel Castro could give 2 shits about BO.
2- Mason kills his double. He just appears near Russalka talking to Dragovich, when Masson’s captured.
3- He isn’t as bashed as Noriega is in Black Ops II.

          • MichiganerE

So what? He was seen as a villain..

          • …..

The Cuban government said something about Castro in the game they said “What the United States government did not achieve in more than 50 years, it now tries to do virtually”

          • Siftblade of Rivia

Yeah, I see your point. At least he’s only suing. Kim Jong Un says the movie, The Interview, is considered an act of war, and threatens to “retaliate mercilessly” if it’s released. Pretty interesting, but I can’t help but laugh at the fact that we might go to war because of a Seth Rogen and James Franco movie, lol. It’s all fun and games until someone nukes L.A. πŸ˜›
            http://time.com/2921071/kim-jong-un-seth-rogen-the-interview-james-franco/

          • Brady the Defiled (sillibk)

Thank you, and yeah, I know about that.

          • NuttyTheSquirrel

No. Just because you’re a public figure doesn’t mean you lose your rights, he’s still a human being like you and me.

People just use it without permission. Obama can’t really do much, he’s the president of the U.S. , why would he sue a game company. + Most times someone appears in a game people don’t give them a fucked up role where they actually show something happening (when Noriega kills his soldier in front of Menendez). Also most times someone uses a public character, they’re already dead soo….

But in Black Ops II they really go all out.
Mason: “I’ll keep the garbage (Noriega) in check.”
“Don’t fucking move, you piece of shit!”
“I knew we were giving that son of a bitch too much freedom.”

-Woods: “Dammit, Mason! Keep a close eye on that bastard!”
“I swear, if that bastard breaks cover one more time, I’ll shoot him myself!”
“I can’t wait till this asshole is someone else’s problem.”

I kind of understand Noriega… He still has his pride. And we’re all men, so you understand…

I’m just saying that I understand his action towards Activision.

AND HOLY SHIT, I NEED TO PLAY BO2’S CAMPAIGN AGAIN. Best campaign in an FPS I’ve ever played, WIIIITHOUT-A-DOUBT! (BO+BO2)

          • CriT-

Then why did he wait a whole year and a half after the release of black ops 2 to say oh i dont like how i was depicted , like you signed the contract and signed the script you could of said before the game was out that you didnt like the could he not of.

          • NuttyTheSquirrel

            HE DIDN’T SIGN SHIT.

They just used him, as far as I’m concerned.

+Not everyone knows about CoD, nor is it the most known game. Someone probably told him about that.

          • bRyan

Not that I’m trying to argue with anyone here and I know this May be a little late but most video games including Call of Duty put in the fine print that any similarities are purely coincidental. One popular example would be GTA5. They legally secured themselves with that statement so that it ADVISES the consumer that it is not the person from real life.

          • NuttyTheSquirrel

Exactly, they NEVER use real people on their games. And they still get sued xD…

I’m pretty sure that Activision’s gonna lose this one tho. While GTA V is pretty much safe.

          • TheTempestFenix

  • SilentNova

Anyone else think Advanced Warfare’s campaign will top BOPS 2?

    • ben wills

Won’t be hard. While BO2’s campaign had the best overall level design of the series, the plot was laughably horrible. There was no consistency with the first game, the point to point made no sense. Was just one of the most poorly crafted and idiotic things I’ve ever had to experience. I feel bad for the level design team getting stuck on that game.

      • And no explanation how is everyone so old yet looks so young. Mason was 92 years old somehow and his son was 45 somehow.

        • jordanxbrookes

Yeah a former friend of mine said that not long after Black Ops 2 released, he was like how is David 40-something yet he looks young?

  • Guest

I could see why a regular person would sue, but come on. He’s an 80 year old former dictator in prison trying to get money for what? Extra batteries from the cart everyday for his portable radio? Or an extra pack of Depends? Idk, Technically he has no rights. Being in prison kinda does that to people.

  • IceKoldKilla

It’s not about what horrible things he might have done in the past. It’s the fact that Activision and Treyarch made and continue to make money using his name and face in a partially true past. They used him to add more realism to the game. Is it the same to fight invented bad guys or to fight Fidel Castro, Adolf Hitler, etc. It adds realism and people like that. It makes many buy the game. They show it in trailers. How about I use you face and name and have you do horrible thing in a game that makes billions on dollars a year and not pay you. You’d be butt hurt too guys. Why do y’all whine? Isn’t America where you have douchebags sueing for everything little thing. You claim to be brave and tough in wars yet someone on the street calls you fat or ugly and it’s a lawsuit. You fight someone physically then sue. You over exaggerate things to earn money in a dishonest way taking advantage of the system. Regardless of anything else many Americans do this. It’s such commonly known that games makes fun of it such as Saints Row. There must be twisted lawyers that specialize in exaggerating it all to win a lawsuit against a big company. “My client suffered trauma, depression, blah blah blah because that person insulted and humiliated my client in public” even though both people knew what they were getting into and both insulted and hit each other. Just saying.

    • jordanxbrookes

FTR, I’m British not American πŸ™‚

      • IceKoldKilla

Oh don’t worry. I didn’t mean you. I just read people saying he doesn’t deserve to sue or that he’s butthurt and other shit. My comment is also for any American that will read this. I personally lived in America and know how fucked up the country can be when it comes to justice. Just saying he deserves to be let alone or paid. America capitalizes on so many things included horrible wars, terrorists, deaths, etc. So if they are allowed to earn money off someone horrible in a somewhat true past shown in a game, then that person deserves to be paid. After all it’s because of his horrible actions and past that they used him. It’s what added to the history and story of the game.

  • Jethro

    Dat smile :3

  • Ryumoau

Isn’t this lawsuit about a year and a half too late? Also, they used other real life historical people in there games before like JFK in black ops.

  • NiftyGam3r

Took him 2 years after release to find out they used his image lmao do they have computers in Panama?? Either way activision portrayed him as what he was now he wants to get sentimental. I bet if hitler was alive he probably would have sued half of activision and other games that have used his image. Still doesnt take away he was a murderer

          • Brady the Defiled (sillibk)

I don’t know how you know me from YouTube lol. I changed my opinion on Ghosts because the more I thought about it, the more disappointed I was. Campers, overpowered weapons, the map size, the TTK, etc. It’s the worst CoD I’ve played.

Wait, just to clarify, are you that “Brady`” dude? With the SSJ2 Gohan as your profile pic.?

Completely unrelated to this article, but it seems like on Advanced Warfare that each kill in multiplayer is 50 points:

    http://www.charlieintel.com/wp-content/uploads/2014/06/bit-620×400.jpg

For some speculation, look at the points on the other team (SHG MP 06 has 1 kill and 50 points):

    BigTymer: 12-6 1150
    GReisdorf: 12-2 1125
    SHG MP 04 9-10 950
    SHG MP 10 4-9 710

Does this mean that Scorestreaks are returning or not? Looking at BigTymer’s score, it should total 600 points (12×50=600), unless he got a lot of assists. Also, SHG MP 10 has 4 kills, and 710 points. So do you get points for playing the objective again? We’ll see. They probably just got a bunch of assists.

      you just figured that out?

        Yup

Scorestreak system is awesome, but as I have said before, don’t make the system like that UAV takes 500 points to get. It was really hard to simply get UAV… highest streak in BO2, which I got, was Lighting Strike…

EDIT: And if somebody in the team is team player, it’s me. I’m almost always the number 1 player in my team.

            Agreed.

I think the point In CTF is always 50 right ?

Destiny is going to put Advanced Warfare to shame. The gulf between the two games is staggering. AW just doesn’t get me interested in the slightest anymore.

At least the hype is minuscule for COD this year so when it’s a massive letdown as usual; people wont be too disappointed.

    • Guywithbrains

I have played Destiny beta. It isn’t anything revolutionary. In missions you just go to same places to shoot same enemies with different levels. Then they spawn endlessly behind the corner. Also PvP was boring, because it played too much like Halo. Still Destiny is looking good and playing with friends is cool.

Compared to previous CoD titles, I have the most amount of hype yet. So I don’t know what you are talking about hype being minimal.

Oh and seems like you have played Advanced Warfare. How was the multiplayer? Yes, you can’t know if it is massive letdown or not before you get actually play it. πŸ˜‰

Destiny is a fantasy MMO. The genre is nothing new and most of the gameplay features shown in the game have been done by other games in the genre. It is your opinion that “Destiny is going to put Advanced Warfare to shame” and that there is a “gulf between the two games”. The hype is not “minuscule for COD this year”.

Agree. It’s funny how so many Xbox One users are butthurt about Destiny and it being content exclusive on the PS4. They loved Bungie with Halo when that was a Microsoft exclusive but now they’re bitter that of how astonishing this game is for Sony. I’ve seen some are refusing to buy it on the One because of this but they’re the ones going to be missing out and let’s face it; there isn’t any other good games on that console. Ryse is probably the best.

Destiny is the first major MMO for console and the most ambitious game ever created. People say it’s nothing new but then again, Advanced Warfare is not either but that doesn’t stop them hyping it to death. Destiny is a breath of fresh air and the plans Bungie have to this in the future is incredible. In a terrible next gen; this game is going to change gaming forever. It’s going to be the best game ever created and those bitter Xbox users should just stop crying and enjoy the game regardless of it being superior on PS4.

      The hype isn’t miniscule I don’t think.

It’s the expectations that are at an all time low. I’d be happy with AW getting a 7/10 score to be honest.

Agree that Destiny will be on another level though.

Prepare for information blowout in the next few days.

    • Guywithbrains

I wish that it goes like that. I am dying, because we haven’t got any big new information about Advanced Warfare!

  • Brady the Defiled (sillibk)

    News is dry, eh?
